Standard Terms & Conditions of Hire

For the purpose of this document the following terms of refence apply:

MKSCC     – Milton Keynes Sea Cadets & Royal Marine Cadets
MMH       – Millmead Hall
Hirer        – The individual, group, organisation hiring the space as per the booking form
Function  – Event/activity to be held at the premises by the hirer throughout the designated hire period
Premises – Millmead Hall, Haversham Road, Wolverton, Milton Keynes MK12 5TN
Charges   – Amount payable by the hirer for the use of the premises and any additional charges relating to payment for damage, repair, additional cleaning etc. as required

  • MKSCC strongly advise that all hirers complete their own risk assessment prior to hire
  • MKSCC strongly advise hirers to take out their own event insurance
  • MKSCC do not accept responsibility for any individual being injured or damage to health arising from an event undertaken at MMH
  • MKSCC will ensure that MMH is regularly cleaned and sanitised – this charge may be met by each hirer and is added to the invoice
  • No application for hire will be considered from any individual under 21 years of age.  ID may be required at the time of application.
  • MKSCC do not allow the hire of MMH for parties organised for 14 – 21-year-olds.
  • The person hiring MMH must be present throughout the event they have booked.
  • No part of the premises can be used for any unlawful activities or purposes.  No part of the premises can be used for a purpose other than stated on the booking form.
  • The hirer may only use that part of MMH for which they have booked and paid; the common areas (kitchen, toilets etc.)  being included in all hirings.

Subject to existing bookings, MMH is available for hire as follows:

08.00 – 22.00 Monday – Thursday and Sunday

08.00 – 23.00 Friday and Saturday

Standard Terms & Conditions: #

Accessibility #

  • The ground floor of MMH is on 3 levels but has wheelchair access to all.  The main hall, kitchen and toilets are on the ground floor.  There is no lift to the 1st floor, which is only accessible via the staircase.
  • There are accessible toilets.

Building checks #

  • Upon arrival at the premises a full inspection must be carried out and the on-line checklist form completed.  If any damage is identified, it must be logged in detail with evidential photographs, using the on-line form.
  • At the end of the hire period the hirer must complete the second section of the on-line checklist form.  No deposit can be returned until the checklist has been completed.

Cancellation Policy #

  • MKSCC reserves the right to immediately terminate any hire (or series of hires) should a breach of these Terms and Conditions be made by the hirer.  In such case no deposit or other payment will be refunded.
  • The hirer reserves the right to cancel a hire (or series of hires) in writing/email to MKSCC giving a minimum 4 weeks’ notice at which time any and all related payments will be refunded.
  • Where the hirer wishes to cancel at less than 4 weeks’ notice, 50% of the hire fee paid and 100% of the deposit and cleaning charge will be refunded.

Care of Premises #

  • Hirers are not permitted to attach anything to any surface, wall, or structural part of the premises (internal and external).  This includes signage, banners, bunting, blue-tac, nails, tacks, screws, pins etc.
  • Confetti, powder confetti, cannons and glitter are not allowed on or outside the premises.
  • After use of the premises, all windows and doors must be locked, and the keys returned to the key safe which MUST be locked and scrambled.  The hirer will be held responsible for any theft or damage arising from their failure to secure the premises.
  • The hirer, or the person engaged by the hirer to provide catering, entertainment or other services must clear down at the end of the hire period.  No items may be left on the premises or on site. 
  • At the end of the hire, the hirer is responsible for ensuring that all floors are swept, surfaces wiped, toilets flushed and kitchen and toilet floors mopped.  Further, all food and other waste must be removed from the premises by the hirer.  This includes any helium balloons, which must not be left floating in the ceiling voids.
  • All areas must be vacated at end time of the hire period booked.  This includes the removal of all items brought to the premises.
  • Cleaning materials (including rubbish bags) must be provided by the hirer and removed at the end of the hire.  A broom, mop, toilet rolls, and soap are provided by MKSCC. 

Complaints #

  • Any complaints arising from the hire of the premises must be made in writing to MKSCC within 7 days of the hire period.
  • MKSCC reserves the right to cancel any hire at their discretion.

Damage, Loss, and Insurance #

  • The hirer will be responsible for the premises throughout the hire period and will indemnify the cost incurred by MKSCC because of the hirer’s use of the premises.
  • MKSCC do not in any circumstances accept responsibility for any damage, loss of property or articles placed or left at the premises by the hirer or any guests.
  • The hirer is responsible for any injury or death unless there is proven negligence by MKSCC relating to the premises, the hirer will indemnify MKSCC against all such liabilities.
  • The hirer will indemnify MKSCC for damages, loss or injury associated with deliveries and collections.  The hirer accepts full responsibility.
  • MKSCC’s Public Liability Insurance cover and policy protection cannot be transferred to any hirer in any circumstances.  The hirer is responsible for obtaining the appropriate and required insurance cover for their function.
  • MKSCC reserves the right to remove any posters, banners or advertisements which are unsightly, offensive or explicit.
  • MKSCC reserves the right to remove any items left on the premises and the hirer will be liable for the costs incurred.
  • MKSCC will not be liable for any loss or damage due to circumstances beyond MKSCC’s control including (but not limited to) breakdown of machinery, failure of the electrical supply, leakage of water, fire, government restriction or action, riot, act of war, terrorism or act of God which may cause the premises to be closed temporarily or the hire of the premises to be interrupted, terminated or cancelled.
  • External CCTV is installed around the premises which can only detect who enters and leaves the premises.

Emergencies and Evacuation #

  • In the event of a fire or other emergency, the hirer, and guests (including any contractors, staff and volunteers) must comply with the evacuation procedures laid down by MKSCC.  Emergency exits are at the front and rear of the building.  There is also an exit to the side of the main hall.  The fire procedures are clearly displayed inside the premises and the hirer must familiarise themselves with these.
  • The emergency assembly point is the Bowls Club carpark, and this is signposted.
  • The hirer is responsible for ensuring that any fire exits are unlocked before the beginning of the function.
  • In case of power or heating failure, accident or other emergency which needs immediate attention/necessitates the closure of the premises, the hirer must contact the emergency mobile number, which is clearly displayed inside the premises.

Health and Safety #

  • Any electrical items to be brought on to the premises (including lighting/sound equipment) must carry a current PAT test certificate, a copy of which must be provided at the time of application.
  • Flammable liquids, gases, toxic chemicals, dangerous substances, or any flammable materials (including open flames, fireworks, sparklers, candles* etc.) are strictly prohibited and MUST NOT be brought on to the premises under any circumstances.  (*Small birthday cake candles are permitted).
  • Trampolines and inflatables, including bouncy castles, are strictly prohibited both inside and outside the premises.
  • Illegal substances, knives, firearms, or other items that might be used as a weapon are strictly prohibited from being brought inside or outside the premises.
  • Smoking, including vaping, is strictly prohibited on the premises, and is restricted to the outside of the premises.  The hirer is responsible for the removal of all smoking-related debris at the end of the hire.

Licences and Restrictions on Use #

  • Applications for hire must be made using the online booking form on the MMH websiteThe form must be completed in full to allow the booking to be confirmed.  Set up and clear down times must be factored into the time booked and these must be completed within the agreed hire period.
  • The hirer will ensure appropriate measures are taken to prevent nuisance to local residents, businesses, and other properties within the vicinity.  The hirer is responsible for ensuring noise remains within an acceptable level.  The hirer will ensure that guests leave the premises at the end of the hire period in an orderly and calm manner.  Any complaints received by MKSCC will be sent directly to the hirer and copies may be sent to Thames Valley Police and the Milton Keynes Licencing Authority.
  • If the hirer is intending to advertise and/or sell tickets for a function they remain solely responsible for providing their own Public Entertainment Licence, a copy of which must be submitted to MKSCC at the time of application.  MKSCC may bring this to the attention of Thames Valley Police and the Milton Keynes Licencing Authority prior to the function.  The hirer is also responsible for the provision of SIA licensed doorkeepers and the numbers of such must be in line with recommended ratios.  A staffing plan may be requested by MKSCC at the time of application.
  • The hirer assumes responsibility for the sale of alcohol and MUST obtain the appropriate licence.  A copy of this must be submitted to MKSCC at the time of application.
  • Gambling on the premises is prohibited at all times except for events such as prize bingo – please see link to the Gambling Act 2005 – https://www.legislation.gov.uk/ukpga/2005/19/notes/division/5/3/14/4
  • The hirer must not infringe copyright or allow any copyright to be infringed by any attendee.
  • MKSCC holds a PRS Licence for Music, which will cover most hirers.  However, in the case of an event for which an entry fee of over £20 is payable, then the hirer is responsible for obtaining their own licence (appropriate to the type of event being hosted).
  • Broadcasting, filming, and photography are prohibited unless prior written permission is granted by MKSCC.  Cameras and recording devices are permitted at private functions (non-commercial or public) provided no nuisance, annoyance or offence is caused to any persons attending the function.
  • The premises cannot be hired for politically affiliated events by a specific group.
  • MKSCC and/or their designated representative reserves the right to enter the premises at any time if there is an acceptable cause for concern.  This includes staff, cleaners, key holders, and volunteers.

Parking/Traffic Control #

  • The hirer is responsible for ensuring that no vehicles obstruct the entrances and exits to the premises, access to the highways, public footpaths and surrounding residential areas.
  • Parking is not permitted in the Bowls Club car park, nor must the entrance to the Air Training Corps/Army Cadet Force compound by obstructed.
  • There is additional street parking adjacent to the site. This is free after 5.00 p.m. Monday to Friday and at weekends.

Payments and Charges #

  • It is mandatory that each hirer pay a monetary deposit of £150 by BACS to MKSCC at the time of booking.  Bookings are not confirmed until this has been paid.
  • The full hire charge plus a £30 cleaning charge must be paid not less than 4 weeks before the date of hire, or immediately in the case of bookings made at less that 4 weeks’ notice.
  • Following the hire period, the premises will be inspected and, if no damage or loss is identified, the full deposit will be returned to the hirer by BACS within 28 days.
  • If any damage is identified the deposit refund will be reduced accordingly.

Safeguarding and Inclusion #

  • In the case of functions involving children, young people or vulnerable adults not under the direct supervision of a parent or legal guardian, the hirer must ensure that all appropriate risk assessments and DBS checks are carried out for practitioners, volunteers, and staff prior to the start of the function.  Parents, guardians, and carers are required to ensure that the behaviour of their children is kept under direct supervision for the duration of the function, and they must not be allowed to act in a disorderly manner or cause damage to the premises, its fixtures, and fittings.  This includes all functions involving children as well as performances in line with the Children’s Act 1989.
  • The hirer is responsible for the best practice management of each function associated with the hire.  The hirer must also maintain the objectives of MKSCC as an inclusive community organisation and must not carry out any activity which promotes the exclusion of any community members or be viewed as discriminatory

General #

  • In the event of failure to comply with these conditions, the hirer will pay an hourly rate for any additional hour or part hour for any additional time the premises are occupied plus any amount arising from damage or extra cleaning costs involved.
  • All details provided by the hirer will be subject to MKSCC data protection policy.
  • In the event of a breach of these Terms and Conditions the hirer will forfeit their booking as well as any charges already paid to MKSCC, and the latter will be free to hire the premises to an alternative hirer.
  • MKSCC reserves the right to refuse the use of any article, appliance, or apparatus inside or outside the premises which they consider dangerous or objectionable.  The responsibilities of MKSCC in such matters shall in no way absolve the hirer’s obligations under these Terms and Conditions.
  • The Hire agreement which is the subject of these Terms and Conditions is personal to the hirer and therefore the hirer may not assign responsibility to any other party.
  • Nothing in this agreement is intended to confer any benefit on any person who is not a party to it under the Contracts (Rights to Third Parties) Act 1999.
  • If any provision of this agreement is found by any court or competent jurisdiction to be wholly or partially illegal, invalid, unforeseeable, or unreasonable, then it shall be deemed severable, and the remaining provisions of the agreement shall continue in full force and effect.

  • This agreement shall be governed by and construed in accordance with the laws of England and Wales and the parties’ consent to the exclusive jurisdiction of the English Courts.
